Decision details

It is resolved that:

(A)       Council note the issues raised during the public exhibition of Planning Proposal – City of Sydney Affordable Housing Contributions Review as provided in the Summary of Submissions, shown at Attachment A to the subject report;

(B)       Council approve the Planning Proposal - City of Sydney Affordable Housing Contributions Review, as amended following public exhibition, shown at Attachment B to the subject report, to be sent to the Department of Planning, Housing and Infrastructure to be made as a local environmental plan under Section 3.36 of the Environmental Planning and Assessment Act 1979;

(C)       Council approve the City of Sydney Affordable Housing Program Amendment 2024, as amended following public exhibition, shown at Attachment C to the subject report;

(D)       authority be delegated to the Chief Executive Officer to make minor amendments to the Planning Proposal - City of Sydney Affordable Housing Contributions Review and the City of Sydney Affordable Housing Program Amendment 2024 to correct any minor errors prior to finalisation by the Department of Planning, Housing and Infrastructure;

(E)       Council note the response to matters raised in the Resolution of Council regarding prevention of discrimination against affordable housing tenants in new housing developments, shown at Attachment H to the subject report;

(F)       separate from this proposal, the Chief Executive Officer be requested to provide advice to Councillors on the opportunites and implications of applying affordable housing contributions to a single dwelling, dual occupancy, attached dwelling and dwelling alterations and additions, where and how such contributions may be considered reasonable under the Environmental Planning and Assessment Act 1979;

(G)      Council note the inclusion in this proposal that entrances for affordable housing should not be segregated in future developments and the Chief Executive Officer be requested to provide further advice about opportunities to embed principles or best practice guidance about ensuring equitable and non-discriminatory access to common spaces or core services in mixed-tenure buildings. This could be in the form of amendments to the Development Control Plan (DCP), or other Council documents, pending advice from staff; and

(H)       Council note that changes will not come into effect until that are made by the Minister for Planning and Public Spaces and request that the Chief Executive Officer be requested to provide regular updates to Council about the status of the changes, potentially through quarterly reports.
